1) Introduction
- These Terms of Use (the Terms) govern your access to and use of PDFox, a mobile application offered by Dana Van and available on the App Store.
- By installing, accessing, or using PDFox, you agree to these Terms. If you do not agree, do not install or use the app.

2) Purpose of the App
- PDFox is designed to help you view, manage, annotate, edit, convert, organize, and share PDF documents and related files, within the features provided by the app.
- The app's features may change over time as we update the product.
3) License and Use
- We grant you a personal, non-exclusive, non-transferable license to use PDFox on a compatible Apple device for your own lawful use, in accordance with these Terms.
- You may not use the app in a way that competes with us or for any purpose not expressly included in this license.
- You may not reverse engineer, decompile, or attempt to extract source code from PDFox, or modify the app except as allowed by us in writing.
4) Usage Restrictions
- Do not use PDFox to infringe on others' rights, violate laws, or engage in wrongdoing.
- Do not attempt to access accounts, data, or systems you are not authorized to use.
- Do not remove, obscure, or alter any notices or security features of the app.
- Do not use the app in a way that would disrupt others' use or performance of the app.
- If you use any paid features or in-app purchases, those terms from Apple's App Store apply, and refunds (if any) are governed by Apple's policies.
5) Intellectual Property
- PDFox and all associated code, graphics, and content are owned by Dana Van or its licensors.
- You have a license to use the app as described in these Terms; you do not acquire ownership of any part of the app or its content.
- You retain ownership of content you create or upload through PDFox (your PDFs and notes). By uploading content, you grant PDFox a limited license to process, store, and display that content as necessary to provide the app's features.
6) Privacy and Data
- Your privacy is important. Our Privacy Policy explains what information we collect, how we use it, and with whom it may be shared.
- The Privacy Policy is available within the app and on any official pages we provide. By using PDFox, you agree to the practices described in the Privacy Policy.
7) Third-Party Content and Services
- PDFox may include links or integrations with third-party services or content. We do not control those services, and their terms may differ from ours.
- Your use of any third-party services is at your own risk, and you should review their terms separately.
8) Purchases and Payments
- Some features may be offered for a fee via in-app purchases. All payments are processed through Apple's App Store.
- Prices, features, and availability may change. Refunds and other payment terms are governed by Apple's policies and the App Store.
9) Updates and Modifications
- We may update, modify, or remove features of PDFox at any time without notice.
- Continuation of your use after such updates constitutes acceptance of the updated features and terms.

- You agree that we may communicate with you electronically (via the app, email, or other reasonable means) for purposes related to your use of PDFox.
11) User Content and Data Handling
- You are responsible for ensuring you have rights to the PDF content you upload or annotate within PDFox.
- We may access, store, or process your content as needed to provide the app's features, subject to our Privacy Policy.
- We do not claim ownership of your content.
12) Security
We take reasonable measures to protect your data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
13) Limitation of Liability and Warranty Disclaimers
- PDFox is provided "as is" and "as available." We make no warranties about the app's accuracy, reliability, or availability.
- To the greatest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
- In no event shall Dana Van be liable for indirect, incidental, special, or consequential damages arising from your use of PDFox.
- Our total liability to you for any claim arising from these Terms or your use of the app is limited to the amount you paid for PDFox (if any) in the twelve months prior to the claim, or fifty dollars USD, whichever is greater. If you have not paid for the app, the liability cap is the maximum extent permitted by law.
14) Indemnification
You agree to defend, indemnify, and hold harmless Dana Van, its affiliates, and its and their officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of PDFox, your violation of these Terms, or your violation of any third-party rights.
15) Governing Law and Disputes
- These Terms are governed by the laws of the jurisdiction where Dana Van resides, without regard to conflict-of-laws rules.
- Any disputes arising under or relating to these Terms or your use of PDFox will be resolved in the courts located in that jurisdiction, where allowed by law.
- Before pursuing formal disputes, you should contact us at the email above to seek a resolution.
16) Changes to Terms
- We may modify these Terms at any time. If we make material changes, we will provide notice within the app or by other reasonable means.
- Your continued use of PDFox after changes become effective means you accept the revised Terms.
17) Entire Agreement and Severability
- These Terms, together with any other policies or terms referenced herein, constitute the entire agreement between you and Dana Van regarding PDFox.
- If any provision is found unenforceable, the remaining provisions will stay in effect.
18) Assignment
- You may not assign your rights or obligations under these Terms without our written consent.
- We may assign our rights and obligations to a successor in interest without your consent.
19) Miscellaneous
- If you breach these Terms and we do not act immediately, that does not mean we give up any rights.
- The headings in these Terms are for convenience and do not affect interpretation.
